1. DEFINITIONS

In these Terms and Conditions of Sale, "Seller" means P. C. Chandra Sons (India) Private Limited, a private limited company incorporated in The Republic of India, having its registered office at 127/1A, B.B. Ganguly street Pin- 700012, Kolkata, West Bengal, India; "Buyer" means the person, firm, company or corporation from whom the order is received.

2. THE CONTRACT
  • All orders must be sent through this website https://pcchandraindia.com/ , and are accepted subject to these terms and conditions.
  • The Contract shall become effective only upon the date of acceptance of Buyer's order on Seller's Acknowledgement of Order form.
  • No alteration or variation to the Order shall apply unless agreed in writing by both parties.
  • The Buyer understands and agrees that the goods sold by the seller are hand-made products and although every effort is taken to ensure the design and quantitative aspects of the same, there might be slight variations to the final product with the displayed product. Further, the weight of the final product due to its hand-made nature may vary upto 2%.
  • The Seller reserves the right to cancel an order at its discretion; a refund of any monies paid as advance or otherwise shall be effected at such instance.
3. QUOTATION AND PRICES
  • Unless previously withdrawn, Seller's quotation is open for acceptance within 31st May, 2019.
  • Prices shown DO NOT include Federal and/or Local taxes, rates, levies and other like charges, and the same shall be charged at the time of delivery.
4. ADVANCE AND PAYMENT
  • A minimum of 25% of the quoted price is required to be paid in advance for placing a successful order, along with a duly filled booking form.
  • Payment shall be made electronically in favour of P.C. Chandra Sons (India) Private Limited. Standard Chartered Bank ACCOUNT No. 33205002937. SWIFT Code: SCBLINBB
  • Advances made towards an order are not refundable.
  • Advances made towards a particular order cannot be set-off for an alternate good and/or product.
  • The balance payment shall be made at the time of delivery of the goods and shall include Federal and/or Local taxes, rates, levies and other like charges over and above the price of the goods.
5. DELIVERY OF GOODS
  • Deliveries shall only be made at the NABC Stall, Baltimore, U.S.A during 5th July- 8th July, 2019.
  • Deliveries shall only be made against full and final payment of the price of the goods along with Federal and/or Local taxes, rates, levies and other like charges.
  • Deliveries shall be made against full and final payment in terms of the foregoing clause and upon production of payment proof, order confirmation and a valid photo identity proof issued by the Federal or State Government.
  • Payments shall be deemed to have been received only when such monies are credited to the company's bank account and are freely available to the company.
6. FORCE MAJEURE

Force Majeure of any kind, unforeseeable production or shipping disturbances, war, acts of terrorism, fire, floods, unforeseeable shortages of labour, utilities or raw materials and supplies, strikes, lockouts, acts of government, and any other hindrances beyond the control of the party obliged to perform which diminish, delay or prevent production, shipment, acceptance or use of the goods, or make it an unreasonable proposition, shall relieve the party from its obligation to supply, as the case may be and to the extent that the hindrance prevails. If, as a result of the hindrance, supply is delayed by more than 3 days, the seller shall have the right to cancel the contract.

7. RETURNS POLICY

The seller does not accept return of the goods sold.

8. COMPLIANCE WITH LAWS

If any of the abovementioned terms and conditions mentioned above are in contravention to any Federal and/or State laws then such terms and conditions shall be deemed to be void ab initio, and the surviving portions of this terms and conditions shall remain in force.
